So your appeal to SMART is along the lines I've already indicated in post #3. Add in the additional POFA items.

Same sort of letter to SCS refuting your liability

edit so that the identity of the driver can't be inferred.

Sorry to sound stupid but I cannot find an edit button? Is this because I am new here?

If you’re viewing this on a mobile phone, try turning it sideways (landscape view).

Have appealed with Smart Parking as all letters were delayed going to an old address. I received this response. Will update when I next hear back.

            Good afternoon,

            Thank you for your email.

We would like to inform you that your Parking Charge Notice will remain outstanding with Debt Recovery as no appeal or payment was received within the 28 day time frame, please note we are no longer under any obligation to accept an appeal at this stage.

As an appeal has been submitted, we can confirm this is now waiting to be considered, the appeals team have 35 days to review an appeal and a response will be sent via email.

            Regards,
            Smart Parking Ltd

How do we find the contact information for the landowner in order to submit a complaint? I have searched via google and cannot find anything.
The address is Cardiff Gate Retail Park service yard 1.

Can anybody recommend what to change on this landowner complaint please?

I am writing to you in regards to the PCN issued to reg Xxxxx on Xxxx

I have already appealed with Smart Parking and am currently waiting on a response. They have failed to comply with several acts of the Protection Of Freedoms Act 2012. They have also sent all letters to an old address, hence the delay in appeal.

The driver, after shopping at the retail park, wasn’t aware or any floor markings, or signs on display, perhaps due to the poor siting and lack of prominence.

The driver has stated that locked gates are now on site, possibly because parking measures have only recently been introduced or were in the process of change.

Complaints are currently being prepared to submit to the local MP, to the British Parking Association, and DVLA. Further legal advice will also be taken if needs be but hopefully it doesn’t come to this.

The amount of letters being received is borderline threatening and harassment, so hopefully you will cancel this PCN in good faith.

                Yours faithfully
