  • Parking Fine - N244 form

    Hi, i am new to the group, feeling a bit desperate and less cocky about "how easy it was to get out of a parking fine"

    I will try and be brief.

    1. I received a parking ticket, which I ignored (obviously, wouldn't do that now, knowing what I know). I was not the driver

    2. It escalated and I received a letter from a solicitors firm for the original fine and extra fees, so decided to defend it. As part of my defence, I said I wasn't the driver, which I wasn't.

    3. The case is being dealt with locally by a district deputy judge.

    4. I was asked to file and serve the details of the driver.

    5. I sent the details to the court, but not the Claimant (I didn't appreciate at the time that serve meant to also provide details to the claimant)

    6. I received a letter from the court to say that as I failed to comply with the order, I was in breach of the order and am debarred from contesting that I was the driver of the vehicle.

    7. I wrote to the court with "evidence" that I had replied, but as they rightly state, I failed to send the same response to the claimant.

    8. I received a further letter from the court that says if I want to deny being the driver I need to complete an N244 form and pay £100, rising to £255 if the case is heard in court.

    So my question is, what should I do now? Should I pay the £100 (£255), or not? What are the consequences of not paying? Do I actually have to complete a N244 just for failing to comply to with the order?

    This has been ongoing for months and I am getting quite distressed as feeling totally out of my depth. Any advice would be very much appreciated.

    Why were they asking for the driver details? There is no legal requirement in this civil case to provide it

      Thank you. In my defence I said I wasn't the driver, in response, the court asked who the driver was and to provide driver details. I will take a look at the link. Thanks for taking the time.
