  • Protected Right of way

    Is it lawful to create plots in my right of way which a guy has purchased ,when we brought our land it states on deeds protected right of way .

    If there exists a right of way the owner of the burdened land can sell the land, but that does not extinguish the right of way

      Thank-you for your reply ,problem to us is the plots made from our r o w has a guy living and parking on the plots that was made from our right of way we cannot access barn as we are not lawfully able to move his cars ,he threatens us and we have had to move and rent ,barns now falling down as he is dismantled part of it and he has cut all our trees down now .

        Not sure quite what your situation is, but your action is probably to apply for a court injunction to stop the blocking of your right of way.

        If the barn and trees belong to you he would seem to be guilty of trespass (for which you sue) and criminal damage (which you report to the police.

        What is the nature of the threats he has uttered? It is a criminal offence in England and Wales for someone to harass you or put you in fear of violence.
