Looking for any advice and help as this is my first time I’ve put a post up.
As a result of the financial crisis 2008/2009 my retail business went belly up. As a result I ended I up with a heap of debts with different institutions,one of them being for credit card debt with the Nationwide.
Due to my overwhelming debts and the fact that it was all new to me,
I set up a debt management plan with tStepchange.Nationwide received £13.89/month under. They treated this with contempt and bullied me into paying an additional £35/month.
So, I stood up to them and refused to pay. Next thing I know, Nationwide have issued small claims writ against me (even though they’re still receiving £13.89 from the DMP) and successfully got a CCJ on me. This was clearly an act of retaliation.
I was ordered to pay them £13.89/ month by direct debit. Yes, that’s right, the exact same amount they were receiving in the first place under the DMP!
Because I had some many other larger debts to manage and had zero experience of dealing with collections departments and debt collection agencies, I left the Nationwide debt on the backburner to pay itself.
As I couldn’t find the original court paperwork, I called the Nationwide last week to get an up to date balance of how much was left to pay.
To my shock and horror, I’m now £430.59 in CREDIT!!! That’s the equivalent of 31 months worth of payments !!!
Those crooks have continued to take money from my account despite the debt now being settled.
I’ve had zero communication from the Nationwide by letter or email. They allegedly tried to contact me once by phone!
When I spoke to them, they were obviously very coy and not forthcoming with any useful or relevant information such as why I hadn’t received any notification or what the process sis in these circumstances where a debt subject to a CCJ has been settled. The only thing the woman kept going on about was getting the refund done.
How I’ve left it with them is for them to send me a letter / email explaining what’s happened and why it’s happened before I make a formal complaint.
I’m so angry with theses bandits.
Can anybody tell me what the procedure should have been once the debt had been paid off?
What procedure should the Nationwide have followed or are they not obliged to tell you at all ?
Also, clearly I want the money refunded but also with 8% county court interest and compensation.
How realistic is the Interest and compensation aspect of it?
As I say, It is partly my fault for having taken my eye off the ball, but this is ridiculous!
