  • Civil Enforcement parking charge notice

    I have received the below parking notice. Could anyone please advise what action can be taken to avoid payment?

          Dear Sirs,

          I have just received your Notice to Keeper No. xxxxx for vehicle VRM xxxx

          You have failed to comply with the requirements of Schedule 4 of The Protection Of Freedoms Act 2012 namely, but not limited to, failing to give the invitation to keeper as prescribed by section 9 (2) (e) of the Act. You cannot, therefore, transfer liability for the alleged charge from the driver at the time to me, the keeper.

          There is no legal requirement to name the driver at the time and I will not be doing so.

          I do not expect to hear from you again, or your debt collectors, except to confirm that no further action will be taken on this matter and my personal details have been removed from your records.

          Yours etc


          they have also not given the period of parking 9 (2) (a), nor identified the creditor 9 (2) (h) and therefore can't transfer liability from the driver to the keeper.

            Hi there,

            Further to the above:

            I wrote to the parking company with the advice provided and they have written back (see letter below) stating that the charge was legitimate but that they would accept a lower amount as a settlement.

            Could anyone please advise on the next steps - should I pay or is there anything else I can do?

              I just noticed that the notice you posted up was a reminder. Did you get anything before that?

              They are responding to items that you never mentioned, like the 14 days, and getting it wrong. The period is not when it was sent but when it was received.

                Yes I did receive a parking charge before the one posted at the beginning of the thread. The first notice was received on 03/03/2021 after the incident date of 24/02/2021.

                          Does this change anything? Wary that I was given 14 days at £60 which runs out tomorrow.
