  • BMW Finance Excess Mileage Experian marker

    Hi,

    I recently applied for a mortgage and it was declined due to BMW finance placing a marker on my wife's Experian file for non-payment of an excess mileage charge (£234) for an agreement in 2019. I had no idea that there was a charge as we have never been informed. When I spoke to a rep for this finance company they said that we were emailed about the excess charge in November 2019. We have not seen this email as if it was sent it's more than likely lost in the junk. They were later able to tell us that they sent out the 1st letter about this in August 2020. Again, we have not received this letter.

    I have challenged about this as I have no issue paying the fee, however, their behavior lodging this as a non-payment of a loan is unfair and pretty savage.

    This is the only blemish on our credit history, yet it now affects any future mortgage for the next 6 years!!!!!!. I'm in complete disbelief that this has happened.

    How is it that they can claim to have notified us by email in November 2019, then by a letter almost 1 year later, and that is enough to inform Experian?

    I await their response.

    Anyone able to provide any help?

    You have the right to write to Experian who will and make a note with an explaination on your credit file so lenders can take into account your side of the story.

      EnglandPI, thanks for your interest in my query, and your response. I am currently going through an appeal with my bank to try and get this sorted. My wife will be contacting Experian, however, from other posts, it seems that Experian will not do anything about it unless the finance company advises them it was an error. I doubt they will do that.

        I think what EnglandPI is alluding to is that you can add a notice of correction which is a statement that allows you to explain the reason why a negative marker was entered. Unfortunately, as most lending decisions are automated I am not sure (and would not have any faith in) the notice of correction would have any impact.

        There is another person who has issue with BMW and they are looking to take legal action, link is below so you may want to consider following that with interest if you don't get anywhere.

          So, after many phonecalls to both Alpha Finance (BMW) and Experian, this matter has thankfully been resolved. We paid the outstanding amount due, and the finance company agreed to remove late payment history on Experian which has all been updated.

          I would like to point out though, that it seems far too easy for these finance companies to cripple you for future credit, and they do not seem to be held accountable for trivial issues which affect people for years to come.
