  • Flying Freehold and Neighbours Soil pipes

    Hi All,
    Wondering if anyone could advise us.
    We live in a mid terrace property with a flying freehold passage way inbetween us, the front end of the house is our front bedroom over passageway but it’s the front of their house then the back end of the passage way is their room but the back of our house.... When we bought the house we never noticed this problem and was not picked up by any solicitors and even the sellers declaration didn’t state that any pipe work was over our property or land, but since renovating the house we noticed next doors soil pipes and bathroom pipes are coming out onto our wall we now need to render it but don’t know where we stand ??
    Anyone have any advice

            If those pipes have been there for over 20 years there could be established a prescriptive right.
            From what can be seen of brickwork i suspect the house might have been built before WWii.

            ​​​​​​​I think you will have to be very careful working around the pipes

              Sorry for late reply I could not find the site, as you can see from the photo the top red brick to the left is my property And everything on the right of the property is neighbours property they converted a bedroom to a upstairs bathroom and now have their soil pipes coming out onto my wall and my property, my extensions been built and need to have the back rendered. It don’t know where we stand is asking neighbours to move their pipes in order for us to do it..

                Sorry, but can't match your description to the photo.
                No red bricks on the left,
                I see a horizontal soil pipe with a short down section (perhaps 4') which disappears into the wall.

                You don't say how long the pipe has been there.

                Whether or not it could be rerouted is impossible to say, but you can always ask the owner to move it.
                I can guess what the response will be!
