    I am going to be really honest and would appreciate some advice. I separated from my ex husband over 10 years ago and I built up a lot of debt in my name which I have been paying off since. All the debts have been removed from my credit file but I have been paying them off with the relevant debt agencies. My debt has reduced from just over £50k to about £22k.

    i am hoping to get a mortgage over the next 12 months but I am concerned about the repayment of these debts.
    I have done CCA with them and 5 can’t find and 2 have. I am however worried about stopping payments just in case a CCJ is applied for. My monthly payments are just £5 per month so minimal.
    i have tried f&f settlements and not getting very far.

    Does anyone know if I can get a pre paid debit card for me to make the payments and if I was to apply for a mortgage would they question the outgoing to the debit card? Would they ask for a statement of this?

    also has anyone got any experience of not getting a cca and stopping payments?

      NO CCA no CCJ but of course all the pa lava before case closed! even if the two supplied are they Enforceable/unenforceable> so many factors! whilst paying they are cash cowing you and F/Final why should they they are happy to take monies off you. the dirty Debt scenario, best I would do that is me is stop on the ones not supplied fornow, let them sale to debt purchasers who inevitable offer discounts ?

        all applications you have to list income/outgoings so basically mortgage on back burner

          As you are no doubt aware section 77(6) states:

          If the creditor fails to comply with Subsection (1)

          (a) He is not entitled , while the default continues, to enforce the agreement.


          Therefore this account has become unenforceable at law.

          You have failed to comply with a lawful request for a true, signed copy of the said agreement and other relevant documents mentioned in it, failed to send a full statement of the account and failed to provide any of the documentation requested.


          This is a thought as to why they are not entitled to payment of an alledged debt?
