  • Old Charge on Title Deeds stopping house sale

    Hi, Sorry in advance for the long question and explanation.

    Back in 2010 myself and my wife took a secured loan with a home loan company. The loan was taken over 10 years and of course came with a charge on the title deeds of our home. No problem. The loan ran its course but during which time the company ceased to trade. Our account went over to a new company who purchased the loan. No problem for us no reason for us to think we no longer wanted to pay it so carried on as normal until we made the final payment in April 2020 hooray!!
    Now the bad bit!!
    We put our house up for sale in September 2020 got a buyer immediately and made an offer on a property that we liked. We all expected to be moving home around new year. But in December I got a call from my solicitor saying that there was a Pending Application at the Land Registry against my title deeds and that the sale would have to halted until this was cleared up. We got the information of the solicitors who had made the pending application and gave them a call....... They would not speak with us due to client confidentiality??? We was baffled. After constantly ringing them they finally gave in and told us we would need to speak with Coast Finance.
    It turned out the charge had never been removed and had somehow managed to keep being placed in a state of limbo due to it being in application pending. This since has carried on going back and fourth between the solicitor and land registry apparently due to errors on the application.
    My problem now is we are going to lose the sale of our home on the 28th of this month due to the buyer losing confidence and no matter how much I plead with the Finance Company, Solicitors or Land Registry we just cannot get this resolved.

    Does anyone have any ideas how we could either get this sorted quickly or somehow proceed with the sale with some sort of protection for our buyer??
