    Hi,
    Ive transferred money online mistakenly to another account and that person is refusing to return it even though the bank has told them it was a mistake can the bank just take it out from the account knowing it was mistakenly paid in there.
    Any advise would be much appreciated

      There is a misdirected payments code which your bank may have introduced.

      However if the recipient has already removed the money from their account there is little that can be done

        yes my bank filled in the mis-directed payment form but nothing came from it as the person is not giving permission to return it to me.Ive reported it to the ombudsman who are going to investigate it but I think I will be fighting a losing battle as I think they will get the same answer Could be wrong but what powers does the ombudsman have can they tell the bank to return the money to me even though the its gone into a persons bank? I am so worried.

          So it is theft. Contact the police. I believe there have been successful actions

            Thank you for trying to help Ostell and giving me options I much appreciate it and I agree with you I think it is classed as theft and if nothing comes from the ombudsman I will have a look into that,The thing is I know the person whose account it has gone into and we don't get along big fall out so I no they are being as awkward as hell. Going to court would be expensive as its over £20,000 so its not even the small claims court.
            Only hope is the ombudsman but do they have the power to intervene.

                You are not taking it to court, the police hopefully will. This makes it easier IF you have to claim. The court might even make an order for it to be repaid.

                You give all the details to make a complaint to the police. There may even be an order for you to be repaid

                  Thank you once again for your helpful comments, if nothing comes of it with the ombudsman I will definitely look into the police side of it hopefully they can help because there is no excuse why they are not returning the money as it doesn't belong to them I just mistakenly transferred the money online so I'm hoping they class it as theft.That way like you said the police could take it to court.The only problem is they live abroad but they have their bank here so hopefully that would still be ok.

                    Hi all,
                    daft of me I know but I forgot to mention the persons account has been blocked due to an outstanding balance so they don't have access to the money themselves but when the bank got in touch with them they still wouldn't give permission to for it to be returned to me.
