Hi, I’m helping my sister prepare a defence against a summons from Premier Parking. She paid the right amount, showed the ticket clearly on the dashboard, left the car park before the expiry of her ticket but has been hounded by them for almost 4 years because her car registration didn’t show accurately on the ticket.
if anyone has successfully challenged a claim by premier parking on this basis, I would be most grateful to hear from you
    Thank you,
    jude

Explain about didn't show accurately on the ticket.

What has she done so far about the claim? It's not a summons.

Hello, thank you for your reply.
Yes it is a summons for £194.26.
It was one of those parking machines that ask you to enter your registration number. There were no specific instructions visible that explained the consequences of failing to put an incomplete reg number on it. We later visited the car park again, - when she received the first letter about a 'fine' - and observed that the machine 'went to sleep' within about 2-3 minutes of someone using it. This is what had happened to my sister which resulted in her entering an incomplete reg. number, which she hadn't noticed.
I had pitched our earlier responses to Premier Parking on the basis that they had suffered no loss, since she left the car park well before the expiry of the ticket. I also have photos to show what the machine looks like and alternative machines in our area that tell you to 'press any key to wake up the machine' but we haven't submitted those to the other side yet, I'm just compiling the formal Defence having posted the Acknowledgement of service today.
I think I'm going to have to do some research on contract law, this fine, i think, is an implied term of the contract but the signage is woefully inadequate.
If you could steer me in the right direction, I would be most grateful

So as long as you haven't identified the the driver then look at POFA

My sister has already identified herself as the driver, in correspondence
