Hi, I would be so grateful if i could get some advice.
On Saturday 06/02/21, I received a Claim form from DrydensFairfax on behalf of Arrow Global (original creditor: Halifax ).
Date issued: 05/02/21
Acknowledge : yes on 08/02/21 via MoneyClaimOnline
Total Amount: 13080
Claimant: Arrow Gobal
Solicitor: Drydens
Original Creditor: Halifax
Original Debt: Loan
Particulars:
1. The claim is for the sum of £xxxx in respect of monies owing by the defendant on a credit agreement held by the defendant with Halifax under account number xxxx upon which the defendant failed to maintain payments.
2. A default notice was served upon the defendant and has not been complied with.
3. The balance owed was assigned from Bank of Scotland to the claimant, and the defendant has been notified of the assignment by letter.
Statued Barred: No, I have received letters " Remediation of Account and Notice of sum of arrears from Arrow, and I logged onto an account via Drydens
Any Letters: no i haven't any yet, though from reading previous threads, I believe I should be sending requesting CCA & CPR which i can get onto today
A fixed amount has been debited from my account each and every month since I made the agreement plan (back in 2012 I believe) after defaulting with Halifax. Capquest are still debiting the fixed amount to date. I first received a letter in November 2020, informing me of the transfer to Drydens, then a letter from Drydens asking me to supply a financial income expenditure... which i naively didn't complete due to no change in my financial circumstance, plus the documenting being exhausting. I called Drydens yesterday 08/02/21, and put forward that i haven't missed a payment, to where the representative confirmed that capquest have been forwarding the payments, but that the fixed amount was agreed so long ago i needed to update it and suggested i can cancel the direct debit with capquest, which i told her i wouldn't .The representative also informed me that the only way to move forward now was to respond to the claim and that i WILL get a CCJ.
Where do i go from here?
