Unfortunately, in 2019, I was the victim of a domestically abusive relationship and was forced to take out one contract each with EE and O2 after being manipulated to move counties to live with her (from Newcastle to London).
I could not afford these contracts and therefore defaulted on both of them in 2020.
I have since had advice from the Police, Citizens Advice, and Money Advice Service all telling me to go directly to O2 and EE and tell them what happened and tell them what I would like done about this matter.
EE told me, prior to the default, that they'd be willing to wait for me to receive the handset back from the Police in order to return it and have the debt written off. Later in 2020, I received the handset back from the Police only to be told from EE that the debt was owed in full and that it would not be written off.
Now, O2 have both written off the debt and taken off the default in respect of the instances behind the accumulated debt whereas EE, on the other hand, despite the circumstances behind the debt, have completely declined what I have told them and have told me that I am still responsible for this debt and that the default will not be removed.
Although I wish EE were wrong, I know that they are right in terms of being responsible for the debt and I totally understand that. However, I do not think the default was correctly placed nor issued. The reasons behind my decision are because I have never received a default notice from EE which also means I did not get a chance to pay before the default was added.
EE did send me a full bill for the full amount, but they did not include anything about a default notice or date of default, nor did they include anything else about the default at all, in the full statement.
I have since been in contact with their customer executive complaints team on several occasions only to be told the same thing which is "the default will stay, the debt is still owed, and that any further correspondence will simply be noted and ignored."
This default is seriously ruining my life as it is like a constant reminder of what happened and stops me from getting bank accounts, mortgages, and any other credit. It stops me from living my life.
Does anyone know what I can do?
