  • CCJ agreed to set aside by order of consent, what next?

    Hi, I have been in negotiations with drydens fairfax over the last few months about a ccj I discovered from 2017. It dates back to 2013 according to them from an order with shop direct.

    I had an account and did not use it around that time. After a break up I left the address I was living at and never used the account again. 7 years later I discover I have a ccj so it’s pretty obvious to me my ex continued to use the account and not pay it.

    I have explained all of this to drydens and gathered lots of evidence to back up my claim the ccj was served incorrectly as I never received documents or had the chance to defend it. I filled out an n244 form and added a statement in support.

    they came back to me and said they will accept an order of consent if I pay the balance in full.

    I want a mortgage ASAP so I’m willing to make the payment of around £1500 to get this off my credit file.

    my question is what do I do next? Do I need a new form or do I draw up my own draft to act as the order of consent and get them to sign it? Then send it to the courts? I read somewhere I’ll have to pay £100 which is fine. I just need to know my next step so I can get this done as soon as.
