  • Highview Parking

    Have received a notice from Highview parking for a parking charge for a 35 min stay. The "offence" was 10/01/21, the notice states it was issued 22/01/21 but I received the notice on 27/01/21.

    I don't believe this is within the time required (14 days?) but is this for Highview to prove?

    Thanks for any advice.

    No proof required. Assumed delivery is 2 working days, issued 22nd a Friday so delivery assumed on the 26th the following Tuesday so that is 16 days.

    Dear Sirs,

    I have just received your Notice to Keeper No. xxxxx for vehicle VRM xxxx

    You have failed to comply with the requirements of Schedule 4 of The Protection Of Freedoms Act 2012 namely, but not limited to, failing to deliver the notice within the relevant period of 14 days as prescribed by section 9 (4) of the Act. You cannot, therefore, transfer liability for the alleged charge from the driver at the time to me, the keeper.

    I was not the driver at the time an as there is no legal requirement to name the driver I will not be doing so.

    Any further communication with me on this matter, apart from confirmation of no further action and my details being removed from your records, will be considered vexatious and harassment. This includes communication from any Debt Collection companies you care to instruct.

      Thanks, there's instructions to appeal online - better to send in writing?

      Also I'm the registered keeper, but not the driver, I assume its correct for me to provide my details (basically my name) on the letter.

        They already have your name as the registered keeper. As you were not driving then I've modified the appeal. You can appeal on line but there can be pitfalls. If you do then make sure the dropdowns don't default to "driver" and take a screen shot of every page.

          They don't have my name on the letter, its addressed to one letter as the name. Not the right letter, but probably not relevant anyway

            I would query the incorrect addressing, how do you know it's for you?

            What does the V5 say

              V5 is in my name - I checked to be sure. I guess it's meant for me, given it's my car reg and address, but I can add that point to the letter?
