  • MCOL process or next steps specifically post 'DQ sent to Defendant'

    Hello,

    I have filed a case with MCOL against the Landlord and Lettings Agency to recover my tenancy deposit.
    After 2 weeks of filing the case the status on MCOL mentions :
    --Defendant Filed a Defence on date XYZXYZ
    --DQ sent to defendant on date XYZXYZ

    I have few queries in this regards:
    1. What would be the next steps in the process?
    2. Will I get a copy of the Defence filed by the Defendant?
    2. Will I also get DQ from MCOL to action?
    3. What does DQ from MCOL to Defendant contains? Is it possible for me to see a copy?

    Any pointers on this is highly appreciated as I seem to be waging a struggle against a Lettings Agency that's quite seasoned and experienced in forefiting the deposit of the tenants.
    I know 3 tenants by now (there would be definitely many more) who has lost their deposits to this Agency.
    This Agency was also expelled from PRS membership which I surprisingly now see to be back again in the members list. Anyways that's a different and a low priority riddle I'm trying to understand.

    DQ sent to the claimant
    you should get a copy of the defence from the court
    you will get a DQ to fill in
    DQ is basically a blank form but the defendant is required to send you a copy of what they send to the court. Similarly you have to send the DQ to the court with copy to defendant

    You can get a copy of a DQ from the internet

      1. If asked, how many days will I have to send the DQ to the court?
      2. What is expert witness?
      3. I don’t have any witness though I have evidences in the form of emails from the Lettings Agency. How will, having no witnesses would impact my case?

        The letter with the form should tell you the dates
        Expert witness would be a mechanic if it was connected with cars. I don't think you have any
        You have 1 witness, you. Won't impact the case.

        Your emails will go with your witness statement later in the process.
