  • Probate - dealing with a property in the UK and abroad

    If a person dies having left property in the UK and overseas, does the probate /estate have to cover both? We have a situation were property in the UK has been left to 2 executors who wish to sell. The deceased also owns property in Europe (Italy) but this property is part owned with another elderly family member. The family member does not want to part with their half of the overseas property which means that the probate estate in Italy can not currently be resolved. Does this mean that UK property & probate can not be resolved without the European aspect being completed as well?

    Hi, I guess there is no Italian Will? Difficulty is that every country has different estate administrations, so you don't want to go down the path of trying to second guess what the rules are in Italy as you may end up in trouble. You should either consult with, or ask the Solicitor dealing with the estate in the UK to consult with an international probate Lawyer or a law firm in Italy you can liaise with so that they can handle any issues over there and tell you what needs to happen next. When dealing with Probate, its known as a cross-border Estate, and it will take longer at the Probate Office to deal with it. You are likely to need to obtain a Grant of Probate (or the equivalent) in italy as well, but thats where the Italian experts come in to advise
