  • Forcing sale of ex marital home for a disabled relative

    A relative has an inherited degnerative brain disease. She had a difficult marriage and within months of diagnosis she departed the family home and another woman was moved in. The husband apparently dealt with the divorce and she was not supported. This was 7 or more years ago. Despite saying he would, she has never had any divorce settlement and he continues to live in the house. We suspect there are many other issues. She lives in sheltered and supported rental property and is in rent arrears and has had benefits withdrawn because of her part ownership of the marital home. Her condition will only get worse. She has a Power of Attorney who needs to sort this out to prevent her being made homeless. There is so much more. We have all the forms, but could do with some guidance here, there was to have been a rental tribunal but this was postponed by the magistrate because all the legal stuff must be exactly so. We have until about 10th February I am given to understand.
