  • IAS rejections

Hi I am a resident who accumulated 18 parking tickets unaware as I was displaying an out of date permit and was unaware new permits had been sent on my first instance of finding out I had received a ticket as it was postal on a company vehicle I resolved the issue but pcm rejected my appeal and so did the ias as I was not displaying a valid permit as it had expired which I was unaware of as I hadn’t received any new permits which they claimed they did send but I just didn’t receive them so technically I had a valid permit issued to me but was just not on display due to not receiving them in my hand

    what is my next option

    The IAS will reject anyway.

What does your lease say about parking and parking spaces?

That looks as that lease allows you to park in car parking spaces. Is there anything that states where you must park, ie an allocated bay?

What comment did the housing association make about it? They would be the ones that hired them

What do the signs say? Photo would help

not a space I get 3 x parking permit for my property which are renewed and where I hadn’t received anything as of then I just carried on parking with my precious permit and got 18 postal tickets so wasn’t made aware until I received initial letter to say I had one turned out I had 18 I rectified the issue and purchased new permits but they wouldn’t cancel my charges

housing said they would email them but never heard anymore didn’t seem like they could help see them

Obviously with the current situation I didn’t think anything or the new permits maybe they were delayed hadn’t had a ticket on my car also proposals for the council to possibly take over the road so I thought I did the right thing by continuing to display the current and only permits I was aware of

Definitely chase the housing association and ask them why they are derogating from the grant of a parking place by permitting a third party to attempt go charge you when it is not part of your lease.

if you don't pay it will end up in court. Your defence will be that your lease gives you the right to park, does not require you to purchase a permit nor display it, does not require payment to a third party stranger to the lease

Even though there was no requirement in your lease to display a permit you did so for the convenience of the operator. You displayed a permit that was valid and a change of permit validity without you being aware leaves you not liable

Will the housing estate own the roads then or have a say within this parking company

The parking company was probably hired by the housing association without thinking about the residents. The housing association should be able to tell the parking company to cancel.

Are you parking in marked spaces? Is it within the property or an a road outside?

Just on the off chance check with the local council about the status of the road, is it adopted. Quite often the info is on a website

                          What is the location?
