  • Used car nightmare.

    Hi all, I am a newbie to this sight, please be a little forgiving if I mess up.
    I purchased a second hand Nissan Elgrand on the 7th September 2020 deposit was paid on a credit card and the remainder was paid on debit card.
    Since the purchase my car has been back to the garage at least 11 times for numerous faults, most have been rectified, one fault has failed to be sorted, we have a leak inside the car which saturates the boot area and headlining of the car, all attempts to rectify this fault has failed, the options giving to me by the dealer were as follows: they seal the sun roof up completely so that we no longer can use it, they send for a seal from Japan and see if that works, I can purchase another car from them but in doing so I will loose £2700 ( original purchase price of car was £8700 the dealer has offered to by it back for £6000, cost of other Elgrand £9995 all be it a year younger) the car has done less than 1100 miles since purchase ( most of that has been taking car back to dealers a round trip of 32 miles , because the car has to be left there my wife has to take me in her car to bring me home and take me back to garage so all in all a combined total of 64 miles) any advice will be appreciated.

    You can reject the car, ie they return your money less a useage charge but plus any additional costs you have had.

        Quote the consumer Act, If refuses of to Court, if he still will not pay, then eventually, Cant Pay won't Pay, but make sure you sue him personally as well as the car site he trades from, one word of warning make sure you have his name correct and the trading name.

            If he is uncooperative you also have the possibility of making a Section 75 claim against the credit card issuer.
