Hello, I have decided to join the forum as I have a question about a shared freehold: "I own a ground floor flat which is part of a converted Edwardian terrace house. I have a share of freehold with the other freeholder who owns the upstairs flat, which she rents out. There are no other flats or freeholders, just us two. I want to install an air-source heat pump on the flat roof of our extension at the back of the property. Technically this is exclusively part of our property. We normally only consult on the small shared areas such as the front hallway and front garden. The co-freeholder has let me know that she objects to the installation of the heat pump on the flat roof as it would spoilt the view from her back windows and therefore the enjoyment of the flat. My question is - is she legally able to block this work? The roof is mine, and the work requires no planning permission." Thank you.

SCOT22 I've checked and actually the extension isn't on the deeds of the threshold property. The boundary of the building marked on the deeds is smaller and presumably predates the extension. I think I wll take some legal advice on this but in theory it would be possible to install the heat pump on the far end of the extension outside the marked area. I would only do this as a last resort of course - it would be counter productive to antagonise my co-freeholder unnecassarily!
