  • Neighbour refusing access

    Today I had a trades man come round to clear my guttering. I live in detached house and the guttering goes around all 4 sides. One side can only be accessed by my neighbours garden.
    My neighbour does not like me due to a previous problem and now refuses to speak to me. She will communicate with my husband and my parents who live with us. Someone went round at the weekend to ask her and she said she didn’t know if she was going to allow access due to falling out with me. My husband wrote her a letter this morning again letting her know the name of the trades man coming and asking for permission .

    trades man came today went next door to ask if he could clear the guttering and was told he couldn’t go into her garden to do it. So only 3 sides of the house have been cleared and they really needed it!

    my worry now is the guttering must really need clearing. But also what else is she hiding? How do I get around this? Surely I must be able to maintain my property?

    Your solution if access continuers to be denied is found under The Access To Neighbouring Land Act 1992.(Access to Neighbouring Land Act 1992 (legislation.gov.uk)
    Get one of those she still speaks to, to tell her that if she doesn't give permission you will apply for a court injunction under the Act . together with a costs order against her
