  • Scaffolding over a boundary

    I have a property loft conversion and have erected scaffolding on my side of the fence/boundary line but the boards and poles at roof level extend over the neighbouring side. I asked permission before erecting and the neighbour said ok. However once erected next door is not happy and wants it to be removed even though work has stated on the loft and they have cut into the roof.

    You probably have a defence against an action to make you remove the scaffolding under the doctrine of estoppel

    You were given a verbal promise that you could erect scaffolding that would overfly pour neighbour's property.
    On that basis you changed your position ie erected scaffolding
    It would now cause an injustice if that promise is revoked

    Best to talk to your neighbour and try and sort it amicably as after the situation is resolved he will still be your neighbour
