I have sent this query via email yesterday to my local law firm I have used in the past, but have yet to hear from them and intend on getting paid advice, I would just like a rough idea of where I stand.
I have created a website that, amongst other things, crawls a public RSS feed provided by a third party and populates a database. This 3rd party has sent me a copyright infringement 'take down' notice, which I have complied with, but am seeking legal advice as to whether they can claim copyright over the information I am using from the RSS feed. I can provide a link to the RSS feed if that helps clarify things.
The feed itself basically shows a list of retailers, the product, price and an image, EG Nintendo Switch, Amazon, £299, and an image src path, which would have been originally uploaded from amazon to their site. I don't take any information which is 'unique' to them such as description, referral links, and all the information shown is public domain (eg, tesco sprouts 99p along with an image) nor do I link to their site or any assets on their servers
Is their claim to copyright legitimate, ie I cannot display Amazon - Nintendo switch - £299, with an image of a nintendo switch downloaded from their servers on my site? Can this 3rd party claim copyright over an image of a nintendo switch, or HP laptop previously uploaded from another site? This is a multinational company with no doubt a dedicated legal team, I'm just a developer trying to launch a new website. Having researched basic copyright whilst developing, I perhaps wrongly assumed that factual information, eg retailer name, price, product name couldn't be copyrighted.
