  • Court form received too late to file defence within the 14 day period

    Hi

    I have received a court form for a credit card debt. It is date of issue is15th December 2020 + 5 days is 20th December. I Have been away from home over Christmas and picked it up this week on my return, after the 14 day response period which I believe would have been up to the 3rd January. Can I still file a defense? I want, and have good grounds, to dispute the debt. Thanks.

    Try acknowledging the claim online and see where it gets you. You might be in luck

      Hi Ostell Thanks for that. I have done that, it gave me the option to file an acknowledgement of service which I did. It also said about the 14 days, but that if the claiment has not already entered judgement you may file an acknowledgement of service., which I have done.
      If there had been judgement entered, would I have seen it in this process on the "recent transactions for defendant" screen? I could see nothing regarding that so do you think I have successfully filed the AoS to enable me to submit a defence within the 28day period, ie 17th Jan? Cheers!

        If the claimant had asked for judgement then you would not have been able to acknowledge, the case would be blocked. Now you have acknowledged then you have 33 days from the date of issue.

        Get that defence in fast !!
