  • Bw legal threatening me with proceedings

Good afternoon, I received a letter from bw legal stating they’re going to take court proceedings against me for not paying a parking ticket from some private firm that I didn’t even know I had on a car I don’t even have anymore from 2016. I’ve recieved phone call after phone call from them and honestly just thought they were one of those “we’ve heard you’ve had an accident” calls so didn’t call back and just ignored as the message was the same everytime just saying to ring them back. I live in a different address to when they claim I got the ticket so I’m also wondering how they obtained this info on me? The letter was dated a week before Christmas saying I had till the 15th of jan to submit an income/expenditure form telling how much I could pay a month. Please help! I’m self employed now living off universal credit as I haven’t worked since March 2020 due to the pandemic am extremely worried about this.

    would much appreciate some advice

    kind regards

    francesca.

This looks as though it is a letter before claim. They are going to court.

What is the date of the alleged incident, was it after you got rid of the car? While you had the car did you mo e house and forget to tell the DVLA?

CPR 32.14 request to BWL, though you've left it a bit late. Also state that this is the first you've heard about this alleged debt and as the keeper you can have no liability as their client has not complied with 9 (4) of Schedule 4 of the Protection of Freedoms Act 2012 and thus unable to transfer liability from the driver to the keeper. Return the matter to their client

You could complete the income/expenditure form to show that you are most unlikely to be able to pay anything 8f you lose

SAR to the parking company requesting all the have about you and your car

Thankyou for your response, I was supposed to have received the ticket in October 2016 and I had the car it was put on untill 2018 but any time I moved I notified the dvla, and now the first time I’m hearing about it is a week before Xmas 2020. It’s all very odd.
