  • Upholding the wording of an employment contract

    My employment contract states a car allowance of 6k per month, however, I'm paid 6k per year. To be fair the contract is wrong ... but where would I stand if I was made redundant? Could I ask for the contract to be upheld?

    In terms of a redundancy situation the company should include your company car allowance in your notice pay. Howeverthere is no legal requirement for the allowance to be included in the redundancy payment. Your company may include this allowance in your redundancy payment although this would be discretionary.

    However are you actually getting a car allowance of £6k per month and if you know this is wrong I would suggest you be honest and point this out to your employer.
