  • Emergency Hearings

    Hi all,
    I had a bad experience in the family court recently with a judge and would like to get another judge without causing problems. As a litigant in person, a single mom financially struggling he ordered me to do the bundle for the hearing next year. Well can't afford a lawyer am not qualified and don't have time and don't want him again as he gave more contact time to my husband and felt he was biased, but I know I need to do something. Since the next hearing is next year can I get an emergency hearing and ask for another judge saying I felt he was not addressing what my child needed, can't do bundle and so forth? Many thanks

      Hi there thanks for responding. I am in family proceedings at present with another upcoming hearing so I think without having to make another application to the family court I can just write to the court to say I would like an emergency hearing because what the Judge ordered is not working out in my opinion. Think the judge was super biased, but don't have money to pay for transcript etc. nor do I want to at this stage, but need to ask politely for another judge.. Any suggestions or idea which part of the family court I need to write to to ask for another judge and an emergency hearing?

        On the facts that you state, I doubt if an application for an emergency hearing would succeed.

        You allege that a judge dealing with your case was biased. But, again, on the facts you state, I doubt very much that you would succeed in an application aimed at having that judge's order remade by another judge.

        I think you should consider seeking advice from a family law solicitor.
