  • Private parking ticket

I turned into a private parking area at the rear of a parade of shops for literally a few mins having dropped a passenger to quickly buy a sandwich (no available parking).
My car waited at the side, with engine running and was not 'parked' in any bay etc. I was not creating an obstacle for anyone in front, behind or to the side of me. Nobody arrived into the road whilst I was pulled over to the side. Granted this explanation may not be satisfactory but I made representations and these were not accepted (pcn). I have been invited to appeal to IAS but see they are far from independent. Any suggestions what I should do under these circumstances? I lost my self employment income from March as a result of the lockdown and under immense financial hardship and outlined mitigating circs in my representations but these have been ignored of course. This is my first notice from pcn so I'm not a repeat offender etc.

Thanks for the response. I don't have a picture of the sign itself but the charge is issued for 'parking within a restricted area'?

Apologies if I am doing this wrong - looks like I replied but not directly to you? New to this.

          You reply to the forum.

Post up the PCN suitably redacted but leave dates. Use a hosting site such as imgur and put a link on here

A photo of the sign would help

It would help to be able to read all the text on the letter!

              Was there a windscreen ticket?

Edit your first post so that the identity of the driver cannot be inferred. The driver drove and parked, the keeper received th NTK

Apologies - no it was all by post. I don't appear to have an edit option for the first post which was as a guest?

                  Dear Sirs,

I have just received your Notice to Keeper xxxxx for vehicle VRM xxxx

This the first communication I have received from you and therefore you have failed to comply with the requirements of Schedule 4 of The Protection Of Freedoms Act 2012 namely, but not limited to, failing to deliver the notice within the relevant period of 14 days as prescribed by section 9 (4) of the Act. You cannot, therefore, transfer liability for the alleged charge from the driver at the time to me, the keeper.

There is no legal requirement to name the driver at the time and I will not be doing so.

Any further communication with me on this matter, apart from confirmation of no further action and my details being removed from your records, will be considered vexatious and harassment. This includes communication from any Debt Collection companies you care to instruct.

                  Yours etc

If they don't know the driver then you use this when they take you to court
