  • Parking Charge Notice VCS

    Hello, I'm looking for some help.

    I received a £60 Parking Charge Notice from VCS for being parked in a "restricted area". However there were no signs to indicate that this area was restricted. I have attached a couple of pictures which they have of my vehicle and the sign behind it which just states you can't stay for longer than 2 hours. I have tried to appeal it but appealed without naming the driver and they have responded via email demanding that I tell them who the driver was. I have read on other posts that I shouldn't give out the driver's details, any advice?

    So post up the first notice you received.

    there's a lot of other conditions on that sign

        And the dates are ?

        So your appeal should gave been

        Dear Sirs,

        I have just received your Notice to Keeper xxxxx for vehicle VRM xxxx

        You have failed to comply with the requirements of Schedule 4 of The Protection Of Freedoms Act 2012 namely, but not limited to, failing to give notice of keeper liability as prescribed by section 9 (2) (f) of the Act. You cannot, therefore, transfer liability for the alleged charge from the driver at the time to me, the keeper.

        There is no legal requirement to name the driver at the time and I will not be doing so.

        I do not expect to hear from you again, or your debt collectors, except to confirm that no further action will be taken on this matter and my personal details have been removed from your records.

          The date contravention date was 2/12/20 and the issue date was 4/12/20. I just asked why the driver had received the PCN when no offence had been committed based on the information on the sign. Should I go back with your message?

              I can only see the max 3 hour stay but surely that means the signage is not clear so they have insufficient grounds?

                  It does give a list of restricted areas. Was this obeyed?

                    No but it was dark and you couldn’t tell that it wasn’t a Proper parking bay there were already cars parked there.
