  • Law of Property Act 1925 Sections 38 and 62

    Would this apply to a shared water supply pipe repair? Section 62 refers to fixtures that lie within the property boundaries. Section 38 refers to party walls and boundaries. I believe the cost of repairs to a shared water supply pipe should be shared between the properties, but this latest information confuses the situation. Any informed advice would be welcome.

    Please, I really would like help with this. Does it negate my earlier belief that responsibility for a leak in a shared water supply should be shared by all the neighbours sharing the water supply?

        We neighbours haven't spoken since the work was finished, but, as far as I know, none of us has yet had a bill for the work done or the original call-out. I just want to be clear in my mind as to the responsibility, if there should be another leak at another point in this shared water pipe. I don't want to be insisting that I'm in the right, if I'm not. (The reference to the Law of Property Act came from someone I consulted - but it contradicts what I had come across before).

          The trouble with researching in advance is that one imagines all sorts of scenarios!

          I would wait till the bills arrive and then try and sort it amicably without reference to law.
          If in the end you can't do that, then is the time to research your legal position
