    Hi i have a ccj pending with T M Legal Services in Blackpool for a alleged payday loan through a company i have not heard off. so i asked them for proof we are now at the stage of going through the small claims court i have received a court hearing date for next year and i have a couple off weeks to put my defence in, i rang them to try and avoid the court action as advised by the court, they advised me they do not do Tomlin orders and i would have to write to the court to withdraw my defence before they would come to a plan arrangement. Is this infomation request correct or can they as the claimant cancel the proceedings. thanks

    So have you you raised a CCA request with them to get details of the alleged loan? They can withdraw the proceedings at any time, they may be worried about your defence.

      If you withdraw your defence they will most likely get a default judgement against you so you are no better off than saving like mad and fighting them in court. Maybe you want to give some details so people can give advice. How much is the claim for?
