    Hi,

    I have been living abroad for the past 5 years. My property in the UK was rented where the same tenant lived in the property for 5 years. Earlier this year he served notice to vacate the property. When my agent conducted the checkout report I noticed extreme wear and tear to the property and the furniture. In lieu of this I requested forfeiture of a small amount from the tenants deposit.

    9 months later the tenant gets back in touch with a CCJ order asking me to pay 2 times the deposit amount + costs to the tenant. I was not even aware of a claim and a court case until the tenant contacted me. I am now trying to set the judgement aside and need help with this.

      Presumably awarded because the deposit was not in a scheme - were all necessary steps taken when renting (deposit in a scheme, gas checks, information handed over as required etc)? If set aside then the case may be reopened and you will have to prove this is the case. Clearly you do not want a CCJ and are right to set aside but be aware of what may come next!
