  • Lowell & Notice If Proposed Allocation to Small Claims Track

    Hello and thank you for allowing me to join.

    Ill keep this brief brief and see if you direct me to another ‘room’

    Lowell are chasing me up for a debt of just over £1400.

    This is not my debt, I have not entered any credit agreement. This goes back to 2013 and Lowell are saying payments stopped in August 2019.
    I have not made any payments.

    I woukd be grateful for any help thanks

      Hi Thank you for your help.

      I have spoke to Lowell today and they have informed me that they are going to Discontinue the case.
      This is not my debt, it seems that the goods were bought by a family member under my name.

      They did send me a copy of the Credit agreement by email, this was signed by the company, but not by me or anyone else. Is this normal ? Would this be the reason they are discontinuing with the claim?

        Check with the court to make sure that the case is discontinued. Not unknown for them to forget and the case trundles on to a default judgement.

          Thanks Ostell really appreciate your advice re Contacting the court.

          Do you know if the contract should be signed signed by both parties to be enforceable?
