  • Tribunal madness

A claim in a Tribunal has been badly handled by a judge. They have waived any requirement for the public body (Respondent) to state their case. There is no Statement of Case at all. Yet I am being forced to enter my evidence not knowing the reasons that public body did all the damage. I therefore cannot supply evidence to counter their case.

I appealed to the Tribunal, but they dismissed it and refused a stay. They also failed to supply the information on how to appeal to the court as per the rules. I have now managed to appeal to the court above.

This means that the Tribunal is going ahead with the hearing, while the appeal court is processing the appeal, but under an order that precludes any evidence from me. They are hearing a case were one side does not need a Statement of Case, and can make up their arguments at the end, and the other is not allowed any evidence. Obviously the public body must win.

The order threatens a costs issue.

How does anyone cope with madness like this. What can be done? I have even said I will not ever be in a case with this judge whatever the out come of the appeal. It was a conditional withdrawal but they still continue. Withdrawals are their decision. It seem like an ambush for daring to question a UK authority.

Anyone know how to find a very old barrister that does not care about their future career, as their own professional regulator is the person that caused the damage originally as they worked for the public body.
