  • JCT Contract Adjudication Appeal

    Having lost a JCT Adjudication of which I instigated to some surprise I was told that there was no formal appeals process via the complaints system.
    The ADJUDICATION was via the RICS approved service.
    The shock of losing was compounded by the shock of also having to pay for the privilege of using the process (which I know can be awarded to a party or split).

    The decision was illogical and unsupported, my evidence was significant and proved breach of contract of multiple terms.
    The builders evidence and counter claim was flaky.

    Can this be challenged in a cost affective approach?

    You can mount a challenge to the Adjudicator's decision only by issuing court proceedings. There are only 2 grounds, perversity or that the Adjudicator misinterpreted the law.
