    Hi,

    All help is really appreciated.

    I have received a parking invoice today. The recorded date of parking was the 24/10/2020 and I have only received the letter through the post today 14/11/2020. Is there a strict time frame that they must notify you of the invoice? The date of notice on the letter is 04/11/2020 which is clearly not accurate.

    Furthermore, I was at work on the day and was not the driver however I am the registered keeper. Is there any grounds for me proving this and appealing?

    The car park is free but apparently has a 2 hour maximum stay.

    They try to hide the fact that they have been sent out late. Was there a postmark on the letter?. There is a 14 day limit for the invoice to be delivered if no windscreen ticket.

    Post up the invoice, suitably redacted, both sides.

            Several POFA fails there. However:


            Dear Sirs,

            I have today, 14th November, received your Notice to Keeper No. xxxxx for vehicle VRM xxxx.

            You have failed to comply with the requirements of Schedule 4 of The Protection Of Freedoms Act 2012 namely, but not limited to, failing to give notice of keeper liability as prescribed by section 9 (2) (f) of the Act.

            You have also failed to deliver the notice to me with the relevant period of 14 days as required by (9) (4) of the Act.

            You cannot, therefore, transfer liability for the alleged charge from the driver at the time to me, the keeper.

            There is no legal requirement to name the driver at the time and I will not be doing so.

            I do not expect to hear from you again, or your debt collectors, except to confirm that no further action will be taken on this matter and my personal details have been removed from your records.

            First class post with free certificate of posting from a post office.
            They have also failed to give the invitation to keeper in the format required 9 (2) (e), no period of parking 9 (2) (a) - moving in front of a camera cannot, by definition, be parking

            They will reject but give you a POPLA code. You throw everything into the POPLA appeal

                Will I receive a POPLA code even though I’m in Scotland? Thought I read that was just England and Wales?

                  I prefer post, with a certificate, as that is something to wave in their face if the say they didn't receive it.

                  By all means do it online but make sure you take a copy of each screen and make sure no of the dropdown menus default to driver

                        Wish you had said earlier that it was Scotland. No POFA in Scotland.

                        General Advice in Scotland is ignore. Or visit the store again and demand that the manager get it cancelled
