  • Parking Fine - CP PLUS

    Hi

My wife was at Birch service station for just under 3 hours and we just got a parking fine of £60 if we pay within 14 days.

We are really strapped for cash now because of Covid is there a way we can get out of it?

She wasn't aware that there was a maximum free time at the services

    Thank you

Edit so that the identity of the driver cannot be inferred, use "the driver....." etc.

    Dear Sirs,

I have just received your Notice to Keeper xxxxx for vehicle VRM xxxx

You have failed to comply with the requirements of Schedule 4 of The Protection Of Freedoms Act 2012 namely, but not limited to, failing to give notice of keeper liability as prescribed by section 9 (2) (f) of the Act. You cannot, therefore, transfer liability for the alleged charge from the driver at the time to me, the keeper.

There is no legal requirement to name the driver at the time and I will not be doing so.

I do not expect to hear from you again, or your debt collectors, except to confirm that no further action will be taken on this matter and my personal details have been removed from your records.

    Yours etc

Unless, of course, it is on the reverse.

They will reject but should successful at POPLA

          HI Ostell

Thank you for getting back to me

Can I appeal with the above using their online appeal or do i need to do it by post?

Also should I add : I was not the driver at the time and as there is no legal requirement to name the driver will not be doing so.

            Yes, use that line.

I prefer a letter as you can show it was sent but by all means do it online but copy each screen as you go and be careful of any dropdowns that default to driver

                Good, another success

By the way it is not a fine, it is an invoice for a charge agreed for an alleged breach of contract.

                  Hi Ostell

We just got another 'invoice' from Euro car parks.

Could we use the same thing as above?

I am the registered keeper my wife was driving the car at the time .

She remembered paying but we can't find it anywhere.
