I went to a Napier car park, drove round and round trying to find a space, finally found one after over 10 minutes but left after a minute or two because it was ridiculously busy and there was no social distancing whatsoever and we went to a different lake instead. I received a parking ticket because I was in the car park for 17 minutes... I posted an appeal just before the deadline, never heard back, received the final reminder but assumed they hadn't received the appeal yet.
BW Legal are now involved and have been sending letters. On the phone they said I don't have proof of sending the appeal and it has lapsed the appeal time so it's been handed to them. All they ever say on the phone is that I have breached their terms and conditions by going over the 10 minute grace period and not buying a ticket and wanted to know what my intentions are.
I said I'm intending to appeal it even if it goes to court because I spent more than 10 minutes just trying to find a space and then left within a minute of sitting in a space because it was too busy and there was no social distancing. I also said that I was not made aware of any 10 minute grace period from any signage upon entry and that If I was aware of this then I would have left before spending over 10 minutes just trying to find a space, or I would have bought a ticket if I realised that I had gone over this even though I still left.
I believe they want to send a claim form next. Surely If this went to court they would realise that I wasn't parking... it was 17 minutes and a very hot day on a weekend in August so the car park was ridiculously busy. What do you suggest I do?
