  • Court Claim DCBL’’

    We live on a private estate and have a permit parking in place. We received a ‘legal recovery action’ letter dated 18/09/2020 with a contravention date of 26/07/2016., asking for £170.00. We have not responded to this or appealed. We received another letter dated 07/10/2020. We have now received a ‘county court’claim Form now asking for £270.63.

    i would appreciate your advice on how to go about this.

    So what does the Particulars of CLaim say?

    have you got any documents relating to this?

    Haver you responded to ANY of the letters?

      Hi Osterley, thanks for responding. 1.The particulars of claim says the defendant (D) is indebted to the claimant (c) for a parking charge(s) issued to vehicle ******* at ********* ******* *** ***2. The PCN details are **/**/**.3 The PCN was issued on private land owned by or managed by c. The vehicle was parked in breach of the terms on cvs signs ( the contract) thus incurring the PCNs. 4 the driver agreed to pay within 28 days but did not. D is liable as the driver or keeper. Despite requests, the pcn is outstanding. The contract entitles c to damages. AND THE CLAIMANT CLAIMS 1. £200.00 2. Interest at a rate of 8% per annum pursuant to s.69 of the county courts act 1984 from the date hereof at a daily rate of £0.04 until judgement or sooner payment. 3 costs and court fees.being the total of the pcns and damages

        Also, I would like to add the the first letter came with a contravention date of 4 years ago and the court letter has a date of 2 years ago. The postcode is also incorrect.
