  • Party Wall damaged by Tree

    Neighbour's tress has "grown" through our double skinned party wall. I have politely advised the neighnour a couple of times over the last year or so. Nothing been done and the damages are much worse with the wall being un danger of collapse....Need to get serious, likely it will have to go legal but looking for advise on the content of a pre-action letter..Any assistance would be appreciated

    There is a specialist site garden law which might be worth trying. General advice : keep accurate records and do things in writing.

      An initial letter (send signed for) advising the neighbour of the damage his tree is causing.
      Warn him you will be instructing a structural surveyor to assess the damage and estimate the likely cost of repairs.
      You will expect him to meet these costs
      Advise him to contact his public liability insurers (possibly included in his household cover.

        Need to advise of the damages you have identified (again) and request he responds as to when and how he will address the problem. Failure to repond within 14 days may result in you having to seek legal action to progress, mentioning any costs incurred will be passed to on to him......
