We recently moved to a property which used to all be part of one house. Its detached like a large granny annex really . The owners have stayed in the original property which is listed building - ours however ( ive had confirmation from the council is not within the curtlidge of the listed building and is now a separate dwelling house) As part of the sale the owners wanted us to errect a 6ft fence on the boundary line within 3 months from purchase and as my husband is a tree surgeon we could do this ourselves. However we quickly realised when we moved in the land is very wet and not level so we asked the owners if we could put up hedge instead as it would sit better in the land( very rural). they agreed and we fenced the drive way bit and the , however some of the hedge didn't survive the winter and went brown due to the bad weather and flooding ( this hedge is now coming back to life but it will take a little longer to establish. they are not prepared to wait and want a fence now all the way along. https://speedtest.vet/ https://vidmate.bid/
however in the meantime we put in planning permission for an extension ( the owners knew our intentions when we purchased the house) and they have objected and got all the other neighbours rallied up saying we are in the curtlidge of a listed building and saying we are running the environment etc) as it transpired from the council planning enforcement officer visit we are not in the curtlidge however the fence is as it is creating a boundary to the the listed building next door. so therefore would require planning ( the hedge is fine)
does this mean that the neighbour who stipulated in the sale we put the fence up should be applying for planning for the existing fence or us dow we have to apply? as i feel it should be their responsibility as they stipulated it if that makes sense? any advice? they are turning into quite difficult people i have a feeling they haven't quite let go of the property we purchased of them and thats why they have such a problem with any changes. any advice???
