  • Posting a Letter Before Action for my mother

    Hi, hoping somebody here can help me.

    My mother has recently been in a dispute with a person that she sold some furniture to on Gumtree. Basically, Gumtree has refunded the counterparty but they are refusing to return the item. I've drafted her a letter before action requesting they return the cash to my mother or send back the item. My mother has signed the letter personally.

    Because she is in an at-risk group, she is unable to leave the house and post the letter herself. She has asked me to take the letter to the post office and post it via recorded mail. I am not a solicitor so I wanted to confirm that it would not constitute a reserved activity under the Legal Services Act 2007 for me to post this letter for my mother.

    The clause I am particularly concerned about is 12(1)(a), i.e. that "conduct of litigation" is a reserved activity. Because sending an LBA is part of pre-action protocol if I was to post the letter for my mother would I in effect be conducting litigation? or am I safe because she has signed the letter herself and I am merely posting it?
