  • BMW Financial Excess Mile Charges - PLEASE HELP

    Hi All,

Got a £1450 invoice today from BMW after terminating my agreement last month. I had paid over 50%.

Simple question is do i have to pay or should i tell them im not and see what happens?

Below is what they sent me in the body of the email.
Thank you for recently returning the vehicle shown above.

The vehicle condition report which recorded any damage on the vehicle and also the mileage at the time of the collection has now been reviewed and an invoice has been raised for mileage outside the contractual allowance.

Your maximum total mileage was set out on the front of your agreement, together with the pence per mile charge payable for each mile in excess of this.

As you terminated your contract before the end date, the excess mileage allowance was reduced on a pro-rata basis.

Please note that the excess mileage charge is a pre-termination liability and is therefore payable under Section 99 (2) of the Consumer Credit Act which states that any pre-termination liability is not affected by termination under the voluntary termination provisions.

The invoice, which includes the mileage calculation and damage invoice.

Please note payment is due within 7 days of the date of the invoice(s) and can be made using one of the payment methods detailed below.

Can't help you any more than what is already in the VT guide and what has been posted many times on here. BMW have a habit of marking your credit file, people get pee'd off and upset but do bugger all about it. Only way to resolve it is either to pay up, or take BMW to court and claim breach of data protection either through a solicitor or do it yourself.
If you have a question about the voluntary termination process, please read this guide first, as it should have all the answers you need. Please do not hijack another person's thread as I will not respond to you
