  • Refusal of Payment in Full

    Hello. I recently was unfortunate enough to have High Court Writ of Control against me and goods were seized to be sold at auction.
    To cut a long story short, before goods went to auction I managed to obtain funds to make payment in full via a debit card. The bailiff refused payment and demanded bank transfer only, else auction process would continue and goods would be lost. As time was of the essence, with hours only remaining, I had no choice but to surrender to their demand.
    Surely this cannot be right? Refusing payment in full by legal tender? I thought I could pay by postage stamps as long as it was full and final?
    I stand to learn something if what I thought is indeed wrong??

    Quite easy really - seeing as it had got to such a late stage he wanted guaranteed payment without any chance of you doing a chargeback or similar. Normally only payment by clear funds is taken which is why they prefer bank transfer.

      You make perfect sense, I suppose really it was more a general enquiry rather than my particular issue.
      Too late for me now, but for future reference, is it fact or fiction if payment in full is refused with legal tender the debtor clears debt by default?

      I'm guessing wishful thinking?...

          There have been many instances of payment by different means in the past. Some have been accepted in the past but following many FMOTL claims which is why it has been narrowed to Bank Transfers, Cash or Credit/Debit card payments.
