  • I don't want my ex partner back home.

    I have been living in a jointly owned home with my ex partner who is mentally ill with paranoid schizophrenia. A few weeks back she had a psychotic episode and was sectioned under the mental health act and is still in hospital. There is also a suggestion that she may also be suffering from early dementia. I am in my late 60's and on dialysis, also I am about to (20th October) have a prostaetctomy operation and will need several weeks to recover. I coudn't cope with having her back home as she is difficult at the best of times and my health is failing. I feel she would be better off in some sort of care facility. Bearing in mind this is a jointly owned property and I refuse to have her home where do I stand legally.

    Sorry to hear of your problems.

    The short answer to your question is that your ex has as much right as you to live in the property.

    You could possibly refuse to have her home after her discharge from hospital.
    If she needs care the hospital cannot discharge her unless she has somewhere safe to go.
    This will bring social services into play, who will try and get her back home with you.
    If you stand your ground and convince them that you are unable to care for her (even with a 10 minute visit a day from a carer!) they may then find a place for her in a care home or warden controlled property or suchlike.
    Don't ask about costings though!
