  • Grandparents wanting mediation or a court order

    Hi
    we have had a fall out with grandparents and as parents we didnt feel that letting them see the grandchildren was in the childrens best interest, as a result of this they have made false accusations to social workers and police and for the past year have made life unbearable.
    After none of this has worked for them they have asked for mediation to see the grandchildren .
    we dont feel mediation will work as they have made false accusations, they are not trustworthy and have upset us a great deal.
    They will apply for a court order if we dont agree to mediation.
    Can they do this and then be able to see the grandchildren?
    what are our rights as parents .
    How do we stop them getting access to see the grandchildren .
    We dont feel this will benefit them to have contact.

    Grandparents have the right to apply for a court order for access to their grandchildren

    If a grandparent makes an application to see their grandchildren at the hearing the Court will look at the relationship between the grandparent and their grandchildren, the frequency of contact, and the significance of involvement in their lives.

    It is rare that a court would refuse access unless there is evidence of abuse or violence.
