  • CRS and repayments

    Hi,
I recently had a lot of contact with CRS about a payday loan that was never paid back. I was told to ignore them but then they sent the letter before action so I didn't want to risk a CCJ with them so I paid a small amount to set up a payment plan with them which they accepted.

I paid the amount to secure the payment plan on my card but they've then used the card to take payments which is all well and good but I don't actually know when or what I'm paying them back.

I've emailed them and asked for the payment plan details showing the dates and amounts that I should be paying.
I asked to pay by direct debit so I'm in control.

And I also asked for the annual statements which I believe is a legal requirement and I've never had any.

There reply each time is the same. The balance is on your portal.
But it's not the balance I want. I want payment plan details and and the statements I am entitled to.

Can I stop paying them until they comply with my request?

With Direct Debit they are in control not you, for this you need a Standing Order.

With direct debit, there is a guarantee so if they try and take anything they shouldn't it can be recalled.

No such guarantee with a continuous payment authority
