  • Terraced house having access to rear garden

Hello, we have a very nice terrace house to buy but unfortunately we have let down by the rear share access path. I would like to know if is it possible to block the path legally in case we buy property. The property got a very decent space for bins so I don't see why their is the share access, while there are plenty of terraced houses don't have it. The reason we loved the property is the rooms are massive, and lots of benefits from the property. Thank you.

presumably the easement for this right of way is written into the property deed.

It can be revoked by entering into a Deed of Release with the beneficiary, to formally remove the right.

You may be able to have it removed if you could demonstrate that the purpose for the right of way no longer exists, but if those benefitting from it refuse to agree it is unlikely to be revoked.

You should not just block the access, as it might upset those benefitting from it (even if they appear not to be using it) and you could find yourself in an expensive court case with your neighbours.
