  • Suing a person for defamation of a name and company help needed please

    hi I own a small plumbing company (just me)
    And a previous customer has slandered my name and my limited company name which over 150 people have shared the post on (fb)
    the statement the person has put is untrue which can be proved via my public library insurance as they found i was not liable
    How would it work to send this person to court as I will affect my business and has affected my reputation
    This has just happened today what are the steps I need to take ?

    IMO your best move is to make a complaint about him to the police for an offence under the Malicious Communications Act 1988.
    Hopefully they will warn him about his post and he will remove it.

    Actions for defamation are extremely stressful, and possibly expensive even for the winner, and are to be avoided if at all possible.

    If you are set on taking court action your first step is to write to the offender as required by CPR 53 (https://www.justice.gov.uk/courts/pr...l/rules/part53)

      Thanks des8 only just figured out how to reply

      I would like to take this person to court as i have all the evidence that she is given false details and it is really affecting my business and losing money
      I have sent a letter how ever its still been shared
      I have contacted the police and they wont do anything
      How do i go about taking this person to court ?and what things could i claim for?

          If you are intent on suing this person you need to start with a letter of claim to the poster.

            Yeah I think so I will post it on here with out the address and personal info of course
